Welcome to Neishh.com (“Neishh,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile applications, products, and services (collectively, the “Services”). By accessing or using our Services, you agree to these Terms.

1. Eligibility

  • You must be at least 16 years old to use our Services
  • Users between 16-17 years old require parental or guardian consent
  • If you are using the Services on behalf of a company or organization, you represent that you have authority to bind that entity

2. Account Management

  • You may need an account to access certain features
  • You are responsible for maintaining the confidentiality of your login credentials and all activity under your account

Wardrobe Digitization & Styling

  • Neishh provides AI-driven personal styling services, wardrobe organization, and outfit recommendations
  • Our algorithms analyze your uploaded wardrobe items, style preferences, body measurements, weather data, and occasion needs
  • Recommendations are generated using machine learning but are suggestions only – final styling decisions remain yours

Service Availability

  • Some features may be in beta or testing phases
  • We continuously update and improve our AI algorithms
  • Service availability may vary and we reserve the right to modify features
  • We strive for 99% uptime but cannot guarantee uninterrupted service

4. Purchases, Payments & Refunds

  • Pricing is subject to change and displayed in Canadian dollars
  • Payments are processed via secure third-party providers (Stripe, PayPal)
  • Accurate billing and shipping information is required
  • Refund Policy:
    • Premium subscriptions: 30-day money-back guarantee
    • One-time purchases: Refunds considered case-by-case within 14 days
    • No refunds for services already consumed or downloaded content

5. Your Content & Data Ownership

Wardrobe Content

  • You retain full ownership of all wardrobe photos, measurements, and personal information you upload
  • By uploading content, you grant Neishh a non-exclusive, royalty-free license to use, process, and analyze your content solely to provide our Services
  • We will never sell your personal wardrobe data to third parties
  • You can request deletion of your wardrobe data at any time

Data Portability

  • You have the right to export your wardrobe data in a standard format
  • Upon account deletion, we will delete your personal data within 30 days (except as required by law)

6. Our Intellectual Property

  • All content on Neishh.com (including designs, text, graphics, software, code, logos, AI algorithms, and trademarks) is the property of Neishh or our licensors
  • You may not reproduce, distribute, or modify our content without prior written consent
  • Our AI models and styling algorithms are proprietary and protected

7. Prohibited Conduct

You agree not to use the Services to:

  • Scrape, harvest, or extract data (including product listings, images, designs, or user information) by automated means such as bots, crawlers, or spiders
  • Circumvent or attempt to bypass technical protections, rate limits, or security measures
  • Interfere with or disrupt the normal operation of the Services, including denial-of-service attacks or traffic flooding
  • Upload content that is unlawful, harmful, defamatory, infringing, or otherwise objectionable
  • Impersonate another person or misrepresent your affiliation with Neishh
  • Use the service for commercial resale without authorization
  • Attempt to reverse engineer our AI algorithms

8. Data Scraping & Automated Access Policy

Unauthorized scraping or automated harvesting of data from Neishh.com is strictly prohibited. This includes:

  • Extracting user-generated content, product data, or styling recommendations
  • Using bots to create fake accounts or manipulate our systems
  • Attempting to access our API without proper authorization
  • Violating rate limits or circumventing access controls

9. Third-Party Services & Integrations

  • Our Services may integrate with third-party platforms (weather services, e-commerce sites, social media)
  • We are not responsible for third-party content, policies, or practices
  • Your use of integrated services is subject to their respective terms

12. Mobile Applications

  • These Terms apply to all mobile platforms
  • App store terms may also apply (Apple App Store, Google Play Store)
  • Push notifications can be managed in your device settings
  • Camera and photo access permissions are used only for wardrobe digitization

13. Service Modifications & Termination

  • We may modify, suspend, or discontinue any part of the Services with reasonable notice
  • We may terminate accounts for Terms violations with or without notice
  • Upon termination, your right to use the Services ceases immediately

14. Beta Features & Updates

16. Limitation of Liability

  • Neishh shall not be liable for indirect, incidental, consequential, or punitive damages
  • Our total liability for any claims shall not exceed the greater of (a) amounts paid to us in the past 12 months or (b) $100 CAD
  • This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory

17. Indemnification

  • You agree to indemnify and hold harmless Neishh, its affiliates, employees, and partners from any claims, damages, or expenses arising from:
    • Your use of the Services or violation of these Terms
    • Your uploaded content or styling choices
    • Any third-party claims related to your account activity

18. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of British Columbia, Canada
  • Any disputes shall be resolved through:
    1. Good faith negotiation
    2. Binding arbitration under British Columbia arbitration rules
    3. Courts located in Surrey or Vancouver, BC (for matters not subject to arbitration)
  • Class action lawsuits are waived where legally permissible

19. International Users

  • Services are primarily designed for Canadian users
  • International users may experience limited functionality
  • Currency, sizing, and weather data may not be optimized for your region
  • Additional terms may apply for international expansion
